C0GTA to beef governance in Tshwane

Following a series of poor governance practices which includes, among others, disregard for the Municipal Finance Management Act (MFMA), especially regarding procurement processes, evidenced by the tenders irregularly awarded to Glad Africa, Aurecon and the alleged loss of R1.6 billion to PEU Group. In addition to that is the frequency of unauthorised, irregular, fruitless and wasteful (UIFW) expenditure as per the Auditor General’s report with the MPAC report indicating that the City of Tshwane investigated only R1, 7 billion of the total R6, 9 billion UIFW.

Moreover, findings on UIFW incurred by the City continue to rise and the City has been slow in effectively applying consequence management over the same period; and constant irregular appointments of senior managers, for example, the Department of Cooperative Governance and Traditional Affairs (CoGTA) received the appointment report of the municipal manager and various managers directly accountable to the municipal manager between January and September 2017, the Department found some areas to be non-compliant with Regulation 17(4) of the Local Government Regulations on Appointment and Conditions of Employment of Senior Managers (2014).

The MEC for COGTA, Mr Lebogang Maile says “Gauteng Executive Council (Exco) has been left with no choice but to invoke the provisions of Section 139(1) read together with Section 154 of the Constitution, by taking appropriate steps to support and strengthen the capacity of the City of Tshwane to effectively execute the constitutional objectives of local government as embedded in section 152 of the Constitution. This will assist in restoring functionality, governance stability and adequate service delivery in the City”.

Furthermore, MEC says “in line with the above, Exco has also instructed the Gauteng Department of COGTA to immediately develop a cogent plan with the appropriate steps to be taken in order to give effect to the Constitutional obligation of the provincial government in terms of Section 154 that will culminate in proper and meaningful support to the City of Tshwane”.
